Privacy Statement Oxbo Apps - FleetCommand and FieldCommand

Introduction

We are Ploeger Oxbo Holding B.V. (hereafter: "Oxbo", "we", "us" and "our") based in the Netherlands with postal address: Electronweg 5, 4706 PP Roosendaal and registered in the Dutch trader register with registration number 65470524. We have created and operate the FleetCommand App and the FieldCommand App (the "Apps"). The FleetCommand App allows a user of the Apps (hereafter: "you" and "your") to monitor your machine remotely on your mobile device and the FieldCommand App allows you to view your machine details and statistics, as well to tweak selected parameters from your device by simply scanning the QR Code on your machine.

Via this privacy statement we, as data controller, aim to inform you how we process personal data in connection with the Apps. For inquiries relating to your privacy, including if you require this privacy statement in a different format, have a complaint, need to update your personal data or wish to exercise your rights set out in this privacy statement, you can reach us via e-mail at info@ploegeroxbogroup.com.

In this privacy statement, references to terms such as 'personal data', 'data subject' and 'data controller' include corresponding terms in data protection laws in other relevant jurisdictions, such the General Data Protection Legislation (GDPR), Privacy Act 1988 (Cth) (Australian Privacy Act) in Australia, Brazilian Data Protection Law No. 13,709/2018 (LGPD) in Brazil, the Act respecting the protection of personal information in the private sector (Quebec Privacy Law) and Alberta Personal Information Protection Act (Alberta PIPA) in Canada, Chilean Law 19,628 on the protection of private life (DPL) in Chile, New Zealand's Privacy Act 2020 (New Zealand Privacy Act) in New Zealand, the South African Protection of Personal Information Act (POPIA) in South Africa, and the California Online Privacy Protection Act (CalOPPA) in California, United States.

This privacy statement describes the types of information we may collect from you when you use our Apps. This privacy statement does not apply to information (a) we collect from you through any in-person or face-to-face interactions we have with you, or through an audio-only telephone conversations; (b) by any other websites or apps operated by us, unless the website or app is listed above or links to this privacy statement; (c) collected by any third party website that we may provide a link to or that is accessible from our Apps; or (d) covered in part or in whole by a separate privacy policy provided by us.

What do we process?

We may also transfer your personal data to recipients outside of our organization for example to service providers such as IT-vendors. In principle we store your personal data in the European Economic Area ("EEA").

We confirm that in order to utilise the functionalities of the Apps, you will be required to provide us with the personal data as set out above. In the absence of providing us with the necessary personal data, you may not be able to utilise the Apps.

We may also process the personal data described above if necessary to comply with legal obligations (for example if we receive a request from a competent authority), to respond to requests, enquiries and complaints received from individuals, in relation to business transactions (such as mergers and acquisitions), to carry out research, for our legitimate interests, in order to enhance, modify, personalise and improve the Apps, or in relation to disputes and legal proceedings. In these cases we will retain your personal data as long as necessary for the relevant purpose and as allowed by the relevant laws.

International data transfer:

We confirm that in principle we only process your personal data within the EEA. The EEA is known for its robust privacy legislation such as the GDPR. If you are located outside the EEA and you provide us with your personal data, you acknowledge and, where required by law agree, you transfer your personal data to the EEA.

If there is any situation we deviate from this principle and process your personal data outside the EEA we will, when required inform you and obtain your consent, and take the necessary measures to comply with the GDPR and other applicable data protection laws to ensure that your personal data is subject to protections equivalent to the in the EEA.

Data Security

We have put in place appropriate technical and organisational measures to protect your personal data against unintended loss or amendment and against unauthorised access, disclosure or processing.

UNITED STATES ONLY:

Security measures

Although we have taken steps designed to protect against the risk of accidental, intentional, unlawful, or unauthorized access, alteration, destruction, disclosure, or use, the internet and mobile platforms are not 100% secure and we cannot guarantee the security of information transmitted through the internet and mobile platforms. We cannot guarantee the security of personal data transmitted to, on, or through our Apps. Any transmission of personal data is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on our Apps, in your operating system, or mobile device.

Children's privacy

Our Apps are not intended for children under 13 years of age. We do not knowingly collect or sell personal data from children under the age of 13. If you are under the age of 13, do not use or provide any information on or to the Apps. If we learn we have collected or received personal data from a child under the age of 13 without verification of parental consent, we will delete it. If you are the parent or guardian of a child under 13 years of age whom you believe might have provided use with their personal data, you may contact us at info@ploegeroxbogroup.com to request the personal data be deleted.

Do not track

Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. However, there is no accepted standard for how a website or online service should respond to this signal and, at this time, we do not take any action in response to such a signal.

Your rights

You have various rights when we process your personal data. Depending on the law applicable in your country, these rights may include, but are not limited to, the right to access your personal data, confirmation of the existence of the processing, the right to correct (i.e. rectify) or eliminate inaccurate personal data, portability of the data to other providers of services or goods, and the right to ask us to stop (i.e. restrict) or to object to the processing of your personal data, and the right to cancel or delete or anonymize your personal data. Where consent is the basis for our processing of your personal data, you also have the right to withdraw consent.

We will work with you to help you access these rights, taking into account any conditions, limitations and exceptions which might apply to your situation under applicable data protection laws.

Further to the rights listed above, you have the right to lodge a complaint with our leading data protection authority: the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, the "DDPA"). If you live outside of the Netherlands, you may also lodge a complaint with your local data protection authority, including the authorities listed below. If you wish to do so, please note that various data protection authorities will only handle your complaint if you have filed a complaint with us first.

The date this privacy statement was last revised is identified at the top of the page. We may update, amend or change this privacy statement from time to time. If we make any material changes to this privacy statement, we will take reasonable steps to notify you, but you are encouraged to review this privacy statement from time to time. If required by applicable law, we will request your renewed consent and acceptance of the change to the privacy statement affecting the processing of your personal data. The most recent version of this privacy statement is always available via the menu in the Apps. If we make a change and it has a material detrimental effect on your use of the Apps you may notify us that you no longer want to use the Apps any time during the 30 day period after we have notified you of the change.

In order to comply with the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties, its Regulations and Applicable Guidelines (the "Law"), Ploeger Oxbo Holding B.V. ("Oxbo"), with address at [ Electronweg 5 4706 PP Roosendaal Netherlandsprovides to you the following:

PRIVACY NOTICE FOR

In order to give a legitimate, controlled and informed processing to the personal data of the users of our FleetCommand App and FieldCommand App (the "Users"), as well as to guarantee their privacy and their right to an informative self-determination when providing us with said personal data, we inform you that Oxbo is the controller responsible for the processing and protection of your personal data, which will be processed based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility provided for in the Law.

When Oxbo must process the personal data of its Users through its controlling companies and/or affiliated companies and/or subsidiaries and/or related parties (the "Related Third Parties") and/or those third parties that, due to the commercial relationship with Oxbo contribute to the provision of its services, Oxbo will always inform them of the content of this Privacy Notice.

PERSONAL DATA WE COLLECT

Oxbo requests and obtains the following personal data of its Users:

FleetCommand

  1. Username;
  2. IP address; and
  3. Device name.

FieldCommand

  1. Username;
  2. Geographical location; and
  3. Device name.

The personal data collected through FleetCommand and FieldCommand will be hereinafter referred to as "Personal Data".

In both scenarios, the Personal Data is collected through access and use by said Users of the corresponding mobile app installed in their smartphone.

In all cases, the collection of Personal Data by Oxbo is carried out in good faith and for the purposes described in the next section. For this reason, it is presumed that the Personal Data provided by the data subjects is true and complete, so the data subject who provides it is responsible of the aforementioned.

PURPOSES OF THE PROCESSING OF THE PERSONAL DATA

Oxbo will process your Personal Data for the following primary purposes:

FleetCommand

  1. To provide the User with our machine monitoring service;
  2. To enable the functionalities of the FleetCommand App;
  3. To link the account to the website; and
  4. To fully comply with applicable laws, regulations and guidelines, internal policies, procedures and legal obligations applicable to Oxbo.

FieldCommand

  1. To offer the User the service of viewing his/her machine detail;
  2. To enable the functionalities of the FieldCommand App; and
  3. To fully comply with applicable laws, regulations and guidelines, internal policies, procedures and legal obligations applicable to Oxbo.

Also, Oxbo may process the Personal Data for the following secondary purpose: to analyze how the FleetCommand/FieldCommand App isused.

It is important to mention that Oxbo will only use your Personal Data for the secondary purpose previously described, if the User consented it. In the event that you do not want your Personal Data to be processed for that secondary purpose, please send an email to the following electronic address info@ploegeroxbogroup.com, indicating your refusal to use your Personal Data for the secondary purpose. If the User does not express his/her refusal to process the Personal Data in accordance with the foregoing, it will be understood that the User has given his/her consent for the processing thereof.

The refusal to use your Personal Data for this purpose will not be a reason for us to deny you the use of our apps.

Once the purposes of the processing of the Personal Data have been fulfilled, and when there is no legal provision that establishes the contrary, Oxbo will proceed to the cancellation, elimination and/or destruction of the Personal Data collected, in the terms established by the Law

TRANSFERS OF YOUR PERSONAL DATA

Your Personal Data may be transferred to fulfill the purposes set forth in this Privacy Notice, only to: (i) service providers and vendors; (ii) commercial partners; (iii) suppliers; (iv) subcontractors; (v) affiliate companies; and (vi) judicial authorities, Mexican and/or foreign, in order to comply with the Law, our commercial obligations, legislation applicable to Oxbo, notifications, requirements or letters of a judicial nature. In case of any transfer of your Personal Data, in which your consent is required, we will inform you in order to collect it.

In all cases, Oxbo will communicate this Privacy Notice to these third parties and will ensure through the signing of agreements and/or the adoption of other binding documents, that said third parties maintain the necessary administrative, technical and physical security measures to safeguard the Personal Data, as well as that said third parties only use your Personal Data for the purposes for which they were collected.

Oxbo will not transfer your Personal Data to third parties not related to Oxbo, without your prior consent.

MEANS AND PROCEDURES FOR THE EXERCISE OF YOUR ARCO RIGHTS

As the data subject of the Personal Data provided to Oxbo, the User may request at any time, the exercise of your rights of access, rectification, cancellation or objection ("ARCO Rights") of your Personal Data.

For this purpose, the User must follow the process of submitting your request in writing to Oxbo through the following email info@ploegeroxbogroup.com1 , which must contain the following information: (a) your full name and email, or other appropriate means to communicate the response to your request; (b) the documents that prove your identity or, where appropriate, that of your legal representative; (c) the clear and precise description of the Personal Data with respect to which you seek to exercise any of the aforementioned rights; and (d) any other element or information that facilitates the location of Personal Data, as well as any other document required by current regulations at the time of submitting the request. You may also request further information on the procedure to exercise your ARCO Rights through this email.

Oxbo will respond to the requests and rule them in the terms and deadlines established in the Law. However, the User can obtain more information about the status of his/her request and the response period for it, by contacting Oxbo or sending your petition to the aforementioned email, where you can also address any clarification or doubt you may have regarding the processing of the Personal Data and the exercise of the ARCO Rights.

WITHDRAWAL OF CONSENT; LIMITATION ON USE AND DISCLOSURE OF PERSONAL DATA

The User may also withdraw, at any time, the consent given to Oxbo for the processing of his/her Personal Data, as well as request that the use and disclosure thereof be limited, as long as it is not prevented by a legal provision and/or the request is not appropriate in terms of the Law. For this purpose, the User must submit your request in writing to Oxbo to the following email info@ploegeroxbogroup.com. Said request must meet the same requirements mentioned in the previous Section.

Oxbo will respond to the requests and resolve them in the terms and deadlines established in the Law. However, you can obtain more information about the status of your request and the response period for it, by contacting Oxbo or sending a request to the aforementioned email, where there can also address any clarification or doubt the User may have regarding the processing and these rights that correspond to the Personal Data.

In the event that the Personal Data has been forwarded prior to the date of withdrawal of consent, and they continue to be processed by Oxbo processors, the latter will be informed about said withdrawal, so that they can proceed accordingly.

USE OF COOKIES OR OTHER TECNOLOGIES

Oxbo states that, with the use of our mobile applications, both FleetCommand and FieldCommand, Oxbo uses own and third party cookies, which shall never identify personally the Users. The different type of cookies used areas follows:

These cookies may be disabled in accordance with the settings on the use of cookies of the browser or internet service you use. Notwithstanding the foregoing, we inform you that the blocking by the User of all cookies may result in the total or partial blocking or impairment in the access and use of our apps.

CHANGES TO THE PRIVACY NOTICE

Oxbo reserves the right to modify and/or update this Privacy Notice, in some or all of its parts, at its sole discretion, in which case it will communicate it by publishing the updated version with the last date of modification, in the FleetCommand App and FieldCommand App, where will be always displayed and the User can review them at any time.

Con el fin de dar cumplimiento a lo establecido en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, su Reglamento y Lineamientos aplicables (la "Ley"), Ploeger Oxbo Holding B.V. ("Oxbo"), con domicilio Electronweg 5 4706 PP Roosendaal Netherlands pone a su disposición el siguiente:

AVISO DE PRIVACIDAD PARAUSUARIOS

Con la finalidad de dar un tratamiento legítimo, controlado e informado a los datos personales de los usuarios de nuestras aplicaciones móviles FleetCommand App y FieldCommand App (los "Usuarios"), así como para garantizar su privacidad y su derecho a la autodeterminación informativa al proporcionarnos dichos datos, le informamos que Oxbo es el responsable del tratamiento y protección de sus datos personales, los cuales serán tratados con base en los principios de licitud, consentimiento, información, calidad, finalidad, lealtad, proporcionalidad y responsabilidad previstos en la Ley.

Cuando Oxbo deba tratar los datos personales de los Usuarios a través de sus empresas controladoras y/o empresas filiales y/o subsidiarias y/o partes relacionadas (los "Terceros Relacionados") y/o aquellos terceros que, por la relación comercial con Oxbo coadyuven para la prestación de sus servicios, siempre les dará a conocer el contenido del presente Aviso de Privacidad.

DATOS PERSONALES QUERECABAMOS

Oxbo solicitará y obtendrá los siguientes datos personales de sus Usuarios:

FleetCommand

  1. Nombre de usuario;
  2. Dirección IP; y
  3. Nombre del dispositivo.

FieldCommand

  1. Nombre de usuario;
  2. Ubicación geográfica; y
  3. Nombre del dispositivo.

Los datos personales recabados a través de FleetCommand y FieldCommand serán definidos como "Datos Personales"

En ambos escenarios, los Datos Personales son recabados a través del acceso y uso por parte de dichos Usuarios de la respectiva aplicación móvil instalada en sus smartphones.

En todos los casos, la recolección de Datos Personales por parte Oxbo es realizada de buena fe y para los fines descritos en la siguiente sección. Por tal motivo, se presume que los Datos Personales proporcionados por sus titulares son veraces y completos, por lo que son responsabilidad del titular que los proporciona.

FINALIDADES DEL TRATAMIENTO DE LOS DATOS PERSONALES

Oxbo tratará sus Datos Personales para las siguientes finalidades primarias:

FleetCommand

  1. Para prestar al Usuario el servicio de monitoreo de máquinas;
  2. Para el funcionamiento de la FleetCommand App;
  3. Para ligar la cuenta al sitio web; y
  4. Para dar cabal cumplimiento a las leyes, reglamentos y lineamientos aplicables, así como las políticas internas, procedimientos y obligaciones legales aplicables a Oxbo.

FieldCommand

  1. Para prestar al Usuario el servicio de visualización de detalles de su máquina;
  2. Para el funcionamiento de la FieldCommand App; y
  3. Para dar cabal cumplimiento a las leyes, reglamentos y lineamientos aplicables, así como las políticas internas, procedimientos y obligaciones legales aplicables a Oxbo.

Adicionalmente, Oxbo podrá tratar los DatosPersonales para la siguiente finalidadsecundaria: para analizar cómo lasFleetCommand/FieldCommand App son utilizadas.

Es importante mencionarle que Oxbo sólo utilizará sus Datos Personales para la finalidad secundaria previamente descrita, si el Usuario la consintió. En caso de que no desee que sus Datos Personales sean tratados para esta finalidad secundaria, favor de enviar un correo electrónico a la siguiente dirección electrónica info@ploegeroxbogroup.com, señalando su negativa para el uso de sus Datos Personales para esta finalidad secundaria . Si el Usuario no manifiesta su negativa para el tratamiento de los Datos Personales de conformidad con lo anterior, se entenderá que ha otorgado su consentimiento para el tratamiento de los mismos.

La negativa para el uso de sus Datos Personales para esta finalidad no será motivo para que le neguemos el uso de nuestras aplicaciones móviles.

Una vez cumplidas las finalidades del tratamiento de los Datos Personales, y cuando no exista disposición legal que establezca lo contrario, Oxbo procederá con la cancelación, eliminación y/o destrucción de los Datos Personales recabados, en los términos establecidos por la Ley.

TRANSFERENCIAS DE SUS DATOS PERSONALES

Sus Datos Personales podrán ser transferidos para cumplimentar las finalidades previstas en el presente Aviso de Privacidad, únicamente a: (i) prestadores de servicios y vendedores; (ii) socios comerciales; (iii) proveedores; (iv) subcontratistas; (v) nuestras entidades afiliadas; y (vi) autoridades judiciales, mexicanas y/o extranjeras, con la finalidad de dar cumplimiento a la Ley, nuestras obligaciones contractuales, la legislación aplicable a Oxbo, notificaciones, requerimientos u oficios de carácter judicial. En caso de realizar alguna transferencia de sus Datos Personales, en los que se requiera su consentimiento, se lo informaremos a efecto de recabar el mismo.

En todos los casos, Oxbo comunicará el presente Aviso de Privacidad a estos terceros y se asegurará a través de la firma de convenios y/o la adopción de otros documentos vinculantes, que dichos terceros mantengan las medidas de seguridad administrativas, técnicas y físicas necesarias para resguardar sus Datos Personales, así como que dichos terceros únicamente utilicen los Datos Personales para las finalidades para los cuales fueron recabados.

Oxbo no transferirá sus Datos Personales a terceros no relacionados con Oxbo, sin su consentimiento previo.

MEDIOS Y PROCEDIMIENTOS PARA EL EJERCICIO DE SUS DERECHOS ARCO

Como titular de los Datos Personales proporcionados a Oxbo, el Usuario podrá solicitar en cualquier momento, el ejercicio de sus derechos de acceso, rectificación, cancelación u oposición (“Derechos ARCO”) de sus Datos Personales.

Para tal fin, el Usuario deberá seguir el proceso presentando su petición por escrito a Oxbo al siguiente correo electrónico info@ploegeroxbogroup.com, la cual deberá contener, la siguiente información: (a) su nombre completo y correo electrónico, u otro medio idóneo para comunicarle la respuesta a su solicitud; (b) los documentos que acrediten su identidad o, en su caso, la de su representante legal; (c) la descripción clara y precisa de los Datos Personales respecto de los que se busca ejercer alguno de los derechos antes mencionados; y (d) cualquier otro elemento o información que facilite la localización de los Datos Personales, así como cualquier otro documento requerido por la regulación actual en el momento de presentar la solicitud. Usted también podrá solicitar a este correo electrónico mayor información sobre el procedimiento para ejercer sus Derechos ARCO.

Oxbo dará respuesta a las solicitudes y resolverá las mismas en los términos y plazos establecidos en la Ley. No obstante, el Usuario podrá obtener más información acerca del estado que guarda su solicitud y del plazo de respuesta de ésta, contactando a Oxbo o enviando su petición al correo electrónico mencionado líneas arriba, donde además podrán atender cualquier aclaración o duda que pudiera tener respecto al tratamiento de los Datos Personales y el ejercicio de los Derechos ARCO.

REVOCACIÓN DEL CONSENTIMIENTO; LIMITACIÓN DE USO Y DIVULGACIÓN DE LOS DATOS PERSONALES

El Usuario también podrá revocar, en cualquier momento, el consentimiento que haya otorgado a Oxbo para el tratamiento de sus Datos Personales, así como solicitar que se limite el uso y divulgación de los mismos, siempre y cuando no lo impida una disposición legal y/o su petición no sea procedente en términos de la Ley. Para tal fin, el Usuario deberá presentar su solicitud por escrito a Oxbo al correo electrónico info@ploegeroxbogroup.com. Dicha solicitud deberá cumplir con los mismos requisitos mencionados en la Sección anterior.

Oxbo dará respuesta a las solicitudes y resolverá las mismas en los términos y plazos establecidos en la Ley. No obstante, usted podrá obtener más información acerca del estado que guarda su solicitud y del plazo de respuesta de la misma, contactando a Oxbo o enviando una petición al mencionado correo electrónico, donde además podrán atender cualquier aclaración o duda que pudiera tener el Usuario respecto al tratamiento y estos derechos que le corresponden respecto a los Datos Personales.

En caso de que los Datos Personales hubiesen sido remitidos con anterioridad a la fecha de revocación del consentimiento, y sigan siendo tratados por encargados de Oxbo, éste hará del conocimiento de éstos últimos dicha revocación, para que procedan a efectuar lo conducente.

USO DE COOKIES U OTRAS TECNOLOGÍAS

Oxbo manifiesta que con el uso de nuestras aplicaciones móviles, Oxbo utiliza cookies propias y de terceros, las cuales en ningún caso identificarán personalmente a los Usuarios. Los diferentes tipos de cookies utilizados son los siguientes:

Cookies esenciales Permiten la operación adecuada del programa, por lo que no podrán ser deshabilitados.
Cookies técnicas Almacena el estado del Usuario respecto de sus decisiones sobre las cookies. Asimismo, es para la administración de sesión.
Cookies analíticas Recuerda: (i) preferencias; (ii) idioma preferido; (iii) cuántos resultados fueron preferidos para ser mostrados en una página de resultados de búsquedas; y (iv) si el filtro de SafeSearch de Google fue activado o no.

Estas cookies podrán deshabilitarse de acuerdo con lo señalado en la configuración sobre uso de cookies del navegador o servicio de internet que usted utiliza. No obstante lo anterior, le informamos que, el bloqueo por parte del Usuario de todas las cookies, puede provocar el bloqueo o afectación total o parcial en el acceso y uso de las aplicaciones móviles.

CAMBIOS AL AVISO DE PRIVACIDAD

Oxbo se reserva el derecho de modificar y/o actualizar este Aviso de Privacidad, en alguna o todas sus partes, a su entera discreción, en cuyo caso lo comunicará publicando la versión actualizada con la última fecha de actualización, en las FleetCommand App y FieldCommand App, en donde estarán siempre exhibidas y el Usuario podrá consultarlos en todo momento.
